I’m an owner of a lot who has a property tenanted. I recently had an application approved for some flooring to be approved against the wishes of a couple of certain lot owners in the building trying to make it difficult for us for no reason. We were in full compliance so it all went through eventually. Since and during the dates of our application and approval process, all of a sudden our tenants have been the victim of bullying and harassment due to them making “noise” constantly in which we have proof that when they were asked to ” be quiet” they weren’t even home or even in the country at one point. My understanding is that wall and floor tiles and its maintenance is the responsibility of the owner. And waterproofing underneath the tiles is the responsibility of the body corporation unless the owner replaces the original tiles and water membrane. But then I’ve been told that the responsibility to maintain the tiles includes the responsibility to maintain the waterproofing under them (including floor water membrane and shower tray under the tiles) and that the tiles and the waterproofing are always an issue for the lot owner. There are 2 balconies in the block of 24 that have spalling and therefore broken tiles. Body Corp has arranged to have spalling repaired and were going to replace broken tiles. But the original tiles are unable to be matched due to the age, So OC they have to suggest another option is to cement, waterproof and paint the patches or maybe entire balcony with an appropriate product. If I want it retiled so it all looks the same, they say I have to pay for tiles to be lifted and replaced. Are OC correct or should they pay for the total replacement? – Louise, NSW
