Q: We have recently bought into a six flat apartment unit block, one couple seem to run the strata and now all of the owners are bullying us so we agree to decisions.
One example is that the one couple is using common property (an external cupboard) for their hot water heater system, a motion has now been put forward is that if we don’t allow them to use the cupboard in perpetuity the strata will have to pay for the water heater to be re-established in their flat. This is happening at the same time that we as the new owners are expected to pay for a by-law for our new gas hot water heater/gas bottles for our flat.
What we don’t understand is why when the external cupboard is being used as common property, they can get away with it, and we have to pay for the by-law. It seems unfair to me.
A: If you believe you are being treated unfairly and that voting is unfair/unbiased, it may be best to reach out to your strata manager for assistance.
If you do not have access to a strata manager, you may be able to lodge a case with the NSW Civil and Administrative Tribunal (NCAT).
It may also be worth having a talk with the couple if there’s a chance you can come to a compromise that benefits both parties.
