Q: Live in large Town house complex with freestanding clubhouse, tennis court, open air pool and spa.

Spa is not in close vicinity to areas used by residents. I wish to use the spa with my husband a few times a week.

I have terminal cancer and find this helpful for my physical and mental health. The strata committee has closed access to all the above facilities, excepting the tennis court, claiming they are following guidelines of the PICA Group. I consider these relate to the usual strata titled buildings, whereas ours is more comparable to a community title situation.

My question is whether in this situation I can use the spa with just my husband when the weather permits.

A: As of midday on 26 March, NSW Health restricted the use of pools. Your committee is therefore adhering to the guidelines provided by the government. To make any exemption would go against the responsibility of protecting all owners and residents in the building.
