The tenant in the unit above mine is using the verandah and one of the bedrooms as a gym. Lots of noise is coming down when they drop the weights on the floor. Can they legally do that? – Peter, NSW

Q: I live in a unit and the tenant in the unit above mine is using the verandah and one of the bedrooms as a gym. Lots of noise is coming down when they drop the weights on the floor. Can they legally do that? There are several sessions a day till late and early morning.

A: If your by-laws do not cover this matter, we recommend starting with a friendly chat with the tenant, as they may be unaware that the noise travels down to your lot. If this does not lead to a resolution, you can consider approaching the owner, landlord, agent or strata manager for assistance in mediating matters with the tenant.

If these avenues do not improve the situation, you could ask your committee or strata manager to draft a formal letter detailing the problem. If all of these steps have failed, you may need to consider applying for a noise abatement order from NCAT.
