Q: A non-owner who is also a non-resident got elected to the SC and now refuses to be an office-bearer or do any work, just content to “listen to everything”.
1. Are non-owners (who held a proxy at the AGM and was nominated by an owner) able to be legitimately elected to the SC especially if they don’t live here and live far away?
2. Are SC members allowed to not do any work and simply “listen to everything”?

 

A: Is NSW non-owners are allowed to be on the strata committee provided they are elected by an owner who is financial (meaning they have no levies in arrears or other fees due), and that they are entitled to vote.

Strata committee members are responsible for the day-to-day running of the strata property. If you feel a committee member is not doing enough in their role you may be able to remove them via a special resolution at your next general meeting. If this is the case, it is recommended that you also put in a motion to re-elect a new committee member to fill the gap if required, so that there is as little disruption to your strata committee and its operations as possible.
