The Buildings Act was modified so that Body Corporates could no longer refuse solar installations purely on grounds of aesthetics… The result seems to be that no-one knows the current state of play. Can you put me in the picture, please. – Kenneth, QLD

Q: The Buildings Act was modified so that Body Corporates could no longer refuse solar installations purely on grounds of aesthetics. There were several appeals to higher courts, with cases won and lost, and the result seems to be that no-one knows the current state of play. Can you put me in the picture, please.

A: You are correct, and despite the updates made to The Buildings Act, there can be a lot of differing opinions and rulings on the matter from body corporate to body corporate.

The best way to proceed would be to speak to your body corporate committee to seek approval and have a resolution worked out at a general meeting.
