Q: Should the demolition of a shed that is shared by two owners but is partly on common property be paid for by the two owners or fully by the body corporate?

 

A: It may be worth looking at your plan of subdivision documents, or body corporate property by-laws. These documents should provide insight into where the shed lies and whose responsibility it resides with i.e. the body corporate or the owners.

Generally speaking, if the shed is on common property and its usage and benefits are shared by all residents, it will be body corporate responsibility. If however, the shed is used exclusively by one or two owners only, it will fall on those owner/owners to pay for works such as demolitions.
