Q: My case is a shared common driveway with another townhouse owner. They parked their car in front of their garage, which results in me having no space to turn my car around. When I reverse my car out of my driveway, it’s actually very risky as the entrance of the shared driveway is at the turning point of a road, so I can’t see the coming vehicles properly.

When I spoke to them they got angry and insist they can park in front of their garage as long as they didn’t obstruct others. What’s my right to protect my safety in a strata property? Is there any legal way?

 

A: If you have access to an owners corporation manager, it may be best to bring this issue up with them. They will be able to provide mediation between you and the other owner.

Another option may be to check your property’s building rules to see if there are rules in place that mention safety concerns with parking such as the view of the road being blocked by parked cars. If there are no such rules in place, you may wish to have them drafted and registered with the help of a legal service provider.

You may also wish to take the case up with the Victorian Civil and Administrative Tribunal (VCAT), although it may be better to first speak to a professional who is familiar with owners corporation laws and legislation.
