Q: I am having continuing trouble with my immediate neighbours and quiet enjoyment. Despite many representations to the strata managers the situation is unresolved. If I refer my issue to NCAT, would it be better to apply for orders against the adjoining lot or the strata manager or both?

A: If you are unsatisfied with your strata manager’s assistance in the matter, it may be best to first contact the strata management company to lodge a complaint. This may result in more cooperation from your strata management company and by extension the strata manager. This will hopefully resolve your issues with your neighbour, or at least get the process moving faster.
In the event that matters remain unresolved, you may then wish to take the matter to NCAT against both, or either one of the two parties. It will be up to you which matters require more urgent mediation and resolution. Either the service issues from your strata manager, or your immediate neighbour and the issues there.
