Must a building caretaking service contractor disclose to the body corporate committee if they are receiving commissions from goods and service suppliers? – Robert, QLD

Question: Must a building caretaking service contractor disclose to the body corporate committee if they are receiving commissions from goods and service suppliers? Would failure to do so be in breach of the codes of conduct under the BCCMA?

– Robert, QLD

Answer: Hi Robert,

This will depend on the contract that the body corporate committee has entered into with the caretaker. If the contract states that the caretaker is entitled to receive a commission, payment or other benefit, then details around the commission, payment or other benefits should be disclosed within the relevant contract.
