Do we need a majority or a unanimous vote to change common property area (i.e. driveways next to the home)? – Rita, NSW

Q: Do we need a majority or a unanimous vote to change common property area (ie driveways next to the home?) We are 3 owners that need to swap over ownership of 2 of the driveways. The third party is not agreeable at this time.

A: Decisions to change common property are usually voted via special resolution at meetings. Special resolutions require the motion to first be passed, and thereafter no more than 25% of eligible voters going against the special resolution.
