Is a strata committee office bearer (chairman) still eligible to remain a member of the committee after their property is sold – Sharon, NSW

Q: Hi, is a strata committee office bearer (chairman) still eligible to remain a member of the committee after their property is sold.

A: The topic can be a little tricky, but the chairperson of your strata committee (who is selling their property) can remain in their role if they were nominated by another owner who has not yet sold their property. OR if the current chairman was self-nominated they would lose their committee member and office bearing role as they no longer count as an owner at settlement.

At the point of settlement, the title for ownership will be transferred to a new owner, making your current chairman ineligible to hold a seat on the strata committee.
