How do self-managed owners corporation serve notices? Josh, VIC
How does a body corporate have to lawfully serve a Notice of Breach on a lot owner if we are a self-managed owners corporation and are only made up of 3 lot owners. Josh, VIC
The rules around serving breach notices in a self-managed owners corporation do not differ greatly from a professionally managed owners corporation.
The official State Government form for a notice to rectify a breach requires the signature of a representative of the owners corporation, so instead of an owners corporation manager a self-managed owners corporation would simply have one or more its elected owners who perform the administrative duties issue the breach notice to the owner.
This can be done via mail. For information on strata managers vs self managed owners corporations, read our article here on the balanced pros and cons of each, or an FAQ response here.
