Can an owner be refused a committee position if other committee members believe they are a troublemaker? – Josie, VIC

Q: Can an owner be refused a committee position if other committee members believe they are a troublemaker?

A: The election of a committee member is the same as any other owner’s corporation decision. It is done by a motion and then a vote for each member. When the committee is declared vacant and re-elected, each member should be voted upon by the owners in attendance or by proxy. In most cases, there are generally no objections, and the vote may not even be formally taken. Owners are within their right to insist on voting and therefore vote against the election of a particular individual/s. A word of caution, though, strata living is about community, and conflicts may arise due to blocking individuals, particularly if the committee still has vacant positions.
