The exhaust fans in the unit have stopped working. Can I please have some clarity on whose responsibility it is to repair, whether it is the owners corporation or the owner (me)? – Vasko, NSW

Q: The exhaust fans in the unit have stopped working (I think the motor has burned out). There are three exhaust ducts in the unit they are in the laundry, bathroom and ensuite. They are all linked together with a duct that runs through the wall cavity and through all the false ceilings and finally exhausting out of the common wall outside of the unit. They are all located in a false ceiling in all three areas that carry the water pipes from the units above mine. Can I please have some clarity on whose responsibility it is to repair, whether it is the owners corporation or the owner (me)?

 

A: It is recommended that you have a look at your strata plan or strata by-laws. These documents should outline whether these fan units are counted as owner responsibility, or common property (which will make it owners corporation responsibility).

Generally, if the exhaust fans are for your use and benefit only, and are located within the area that is counted as your lot/unit, it will be your responsibility to repair/replace them. However, if these fans and their motors sit in common property, the repairs/replacements will be for your owners corporation to handle. Another instance may be that the costs are split between you and your owners corporation, if there are parts that need repairs/replacement in both your lot/unit as well as within the common property.

We recommend speaking to your strata manager, or someone from your strata committee, or bringing the issue up at a general meeting for further clarification.
