Q: My lock up garage roller door was vandalised, leaving it broken and stuck open. The vandals returned overnight and attempted to steal my car, a Toyota Camry year 2000. Only minor damage to the car.

The roller door was fixed which I had to do as an emergency, cost $189. Who is responsible for this cost? Insurance excess is $500

A: We recommend that you check your building’s by-laws first as they may specify who is responsible for maintenance and repairs of the property’s garage doors. You can also check your subdivision plan to be completely sure which areas are owners responsibility and which are body corporate responsibility.

If repairs or maintenance are required, speak to your body corporate manager who will be able to advise you or will address the committee on your behalf to determine who is responsible. If the damage was caused by impact, this may also be covered under the insurance policy.

Please note however that since the damage affects only one lot, it will most likely be your responsibility as the owner of the lot to contact your insurance provider and pay the excess. There may be exceptions, but this will be up to your body corporate to decide.
