An owner in the complex has damage in the bathroom with leaking behind the shower. There is also a $2,500 excess on any repair claim. Is the owner liable for this payment or the body corporate? – Marina, NSW
Question: An owner in the complex has damage in the bathroom with leaking behind the shower.
There has been a claim made on body corporate insurance. The claim is to repair the water leak and have new taps and fittings be installed.
Is the owner liable for the fittings whilst body corporate are liable for the repair water leak behind the wall? Or is the body corporate liable for all the repairs?
There is also a $2,500 excess on any repair claim. Is the owner liable for this payment or the body corporate? There is no policy in place on which way the committee would determine this.

Answer: Hi Marina,
The insurer or broker should advise if this is covered by the body corporateās policy or if it needs to be paid by the lot owner.
