Hi Angel, the Body Corporate and Community Management Act does not permit any by-laws to be made to restrict the type of residential use of a property, this includes discrimintation between long and short term use. The Body corporate is able to revise and amend the schemes by-laws to combat issues such as noise, overcrowding and the overuse of common property. This can include requiring a lot to comply with the local authority’s planning scheme. The short term solution would be to make sure that all new tenants are recieveing a copy of the schemes by-laws to ensure they comply with the rules.
