We have never had a Body corporate on the understanding that in NSW one is not required. Is this still the case? – Allan, NSW

Q: I own a unit which is one of two free standing on a block – both separate units for which both owners have their own insurance including public liability.

We have never had a Body corporate on the understanding that in NSW one is not required.

Is this still the case?

A: It sounds like you live in a “dual occupancy development”, which will not require a body corporate (known as an owners corporation in NSW).

Owners corporations are required only in strata schemes. To check if you are in a strata scheme or not, look at the certificate of title for your property or contact the solicitor who assisted you in the purchase.
