Can some lots have pergolas in my complex while others cannot? – Suzanne, QLD

Q: Is it fair for one part of our Queensland body corporate complex to be allowed to erect a pergola (at the lot owner’s expense), while the other half can’t?

A: Unless temporary or permanent erection of structures is allowed under your body corporate’s Community Titles Scheme (CTS), an individual owner will need to have their request approved on a case-by-case basis from their body corporate committee. If the committee approves one application for a pergola but denies another, ask them to communicate their reasoning for their decision. Under the scheme, it may well be that some lots are allowed these sorts of structures, while others are not in some cases.
